General Terms and Conditions
§ Our General Terms and Conditions of Business apply to deliveries and services.
§ Sales and deliveries shall be made in accordance with the current legal regulations.
§ Deliveries are usually handed over to the post office or an appropriate parcel or delivery service within 3 working days. If we do not have an item in stock, we will inform the customer as soon as possible. In such a case, the customer is free to decide whether he wishes to purchase this article at a later date or whether he wishes to forego the purchase of this article.
§ All prices are in Swiss francs, including VAT.
§ Deliveries are made against cash payment on collection, against payment in advance, cash on delivery or payment by credit card (VISA, MasterCard).
§ Prices and delivery options are subject to change. We reserve the right to charge the prices valid on the day of delivery.
§ Unless otherwise stated, the manufacturer's warranty terms and conditions apply.
§ Complaints due to defects, incomplete or incorrect deliveries must be made in writing immediately, at the latest 10 days from the date of receipt.
§ The goods remain the property of CLASSIC SHOOTING until full payment of the purchase and postage price. We reserve the right to have the retention of title entered in the relevant register and to withdraw from the contract in the event of default in payment.
§ Claims for damages due to errors in illustrations, prices, texts, late or non-delivery remain excluded.
§ Shipping and packaging costs shall be borne by the buyer. The necessary freight costs for the respective product and the packaging costs will be charged. The current postal or freight charges of the relevant parcel or delivery service apply. All postal consignments will be sent "signature/registered".
§ The costs for any export licences are not included in the listed sales prices. These will be invoiced separately.
§ Returns must be made no later than 10 days after receipt of the consignment. Later returns cannot be accepted. Returns of custom-made products are excluded from the right of return. The costs of returns shall be borne by the customer.
§ Offers on the Internet do not constitute an obligation to deliver.
§ In the case of articles requiring a licence, the presentation of the corresponding documents (weapon acquisition certificate/WES as original) is a prerequisite for the purchase transaction. The Swiss Weapons Act shall apply.
§ The place of performance and jurisdiction is at the place of business.
Addendum Shooting Courses
§ With your registration you accept our conditions.
§ Registrations will be considered in the order in which they are received and a place will only be considered firmly booked once the full course fee has been paid. There is a maximum of 6 places per course.
§ Course cancellations without costs are possible up to three weeks before the course. Course fees will not be refunded for cancellations made at shorter notice. Cancellations due to serious reasons (e.g. prolonged illness, death, departure) are excluded. Rebooking with a substitute person is possible at any time without incurring any costs.
§ A course day not attended does not entitle the participant to a make-up, nor is a course fee refund possible.
§ Shotgun shooting is an outdoor sport, i.e. courses are held in all weathers! Please ensure that you are dressed appropriately for the weather and in any case that you wear headgear and ear protection.
§ Insurance is the responsibility of the participant.
§ Instructions from the course instructor must be strictly followed.
§ If a course has to be cancelled for important reasons on the part of the instructor, we will offer alternative dates; if this is not possible, the course fee will be refunded. Further claims are excluded.
Addendum Commission Sale
By signing the commission sale mandate you accept our conditions.
In the event of a sale, a fee of 20 % of the price obtained will be charged.
The commission agent shall make all possible and reasonable efforts to sell the goods on commission. He will always keep the seller informed of his efforts and also inform him of lower purchase offers.
If the seller withdraws the goods on commission before the sale, a fee of 10% of the sales price agreed with the commission agent will be charged.
Addendum Hunting Trips
Markus Felder Classic Shooting, hereinafter referred to as MFCS, arranges hunting package tours in England, Scotland and the Czech Republic. MFCS is not the organiser of these hunting trips, but arranges a hunt at the desired destination that is tailored to the customer's wishes or otherwise announced. MFCS arranges accommodation and catering, endeavours to arrange suitable transport (air/rail) to the place of execution and obtains all necessary permits for the hunt. In the case of individual services provided by other organisers, we act as intermediaries and their contractual conditions apply. This also applies to bookings of individual services such as flights. With the acceptance of an arrangement offer by MFCS, the travel participant and Classic Shooting enter into a package tour contract and, at the latest with the payment of the agreed amount, the travel participant confirms to have received the GTCS of MFCS and to be in agreement with them. The GTCS also apply to third parties for whose benefit the trip is booked.
Services
The prices of our hunting trips are made known to interested parties with our offer. These prices include our services for the arrangement and organisation of the hunt including the booking of accommodation and meals, the organisation of the transfer to the final destination with gun registration, the obtaining of all necessary permits for the carrying of a gun at the hunting location as well as the costs of the service providers on site (accommodation, meals incl. drinks, hunting incl. shooting premiums). Not included are flight and rail costs, costs of any rental vehicles, travel insurance such as cancellation insurance, etc., as well as events and admissions which the traveller wishes to attend as an additional social programme. These costs shall be borne by the traveller. The person making the booking is responsible for payment of the services and for any cancellation costs. Upon acceptance of our offer, a deposit of 50% is due, which at the same time is considered as a fixed reservation of a hunting place. The remaining amount is due for payment upon presentation of the flight or train ticket. We reserve the right to change the tour price, the tour programme or individual agreed services before the contractual start of the tour. Art. 7-10 of the Federal Law on Package Travel of 18 June 1993 (PauRG) are applicable: Prices may only be increased if the cost of transport subsequently increases, fees or charges (such as airport taxes, landing fees, taxes) are newly levied or increased or the relevant exchange rates change, as well as in the event of explainable printing errors. Fares are subject to change at any time and without notice. If the change to the contract is substantial (i.e. the price increase is more than 10%), the customer may notify us in writing within five days of receiving notification of the change to the contract that he/she wishes to withdraw from the contract without incurring any costs or to take part in a substitute journey proposed by us. If the client does not notify us within five days, the change of contract is deemed to be accepted.
We will organise the transfer by plane or train to the hunting destination for you. Inform us of your preferences or any wishes regarding route, stopovers, etc., and we will endeavour to take your suggestions into account. We do not make bookings with easyJet, as we are not convinced by the concept of the low-cost airline (delays, overbooking, etc.). The validity period of the flight tickets usually starts with the first flight date and is 1 year. If it is an open ticket (without any reservations), the validity period runs from the date of issue of the ticket. In most cases, flight bookings are basically fixed, i.e. flight reservations can only be rebooked to a limited extent and are not transferable! When the flights are booked, we receive a booking confirmation with the corresponding e-ticket number, which is immediately forwarded to the participant. Corresponding contact details of the participants are also left with the airlines so that travellers are informed directly by the airline in the event of changes to the flight schedule, delays, etc.. However, this does not release the traveller from the obligation to enquire personally and in good time at the airport or with the airline about the implementation or any flight changes. MFCS accepts no responsibility for damage resulting from failure to comply with this obligation and rejects any liability claims in this connection. It is also advisable to check the travel details for rail journeys well in advance!
A minimum number of three hunters per group and stay (maximum five hunters) applies to our hunting trips. Where the minimum number of participants is not reached, we reserve the right to cancel the trip at the latest before the flight is booked and will refund the prices paid. Any further claim is excluded. It is possible to run a group below the minimum number of participants on the condition that the cost of the remaining participant(s) will be passed on to the booked participant(s).
Safety information
The trips arranged by MFCS focus on the hunting of flying and cloven-hoofed game and the handling of hunting weapons (shotgun, rifle). The participants confirm that they are aware of the dangers of using a weapon and that they are experienced in the use of such weapons and that they meet the legal requirements for carrying a weapon. They also confirm that they have sufficient liability cover. Participants undertake to follow the instructions of the hunting guide/gamekeeper. Repeated improper, incorrect and dangerous behaviour by a participant may lead to the exclusion of the participant or to the termination of the hunt. In such a case the missing participant is fully liable for the loss of the hunt.
Weapons transport / European firearms passport
Please let us know if you wish to take your own weapon(s) with you on your trip so that we can initiate the process of obtaining transport permission from the airline or railway company in good time. In order to take the weapon(s) with you, the participant must have a valid European firearms pass in which the weapon(s) is/are registered. The weapon(s) must be transported in a special and lockable weapon case. There may be delays at airports due to the transport of weapons, so we recommend that you arrive at the check-in as early as possible. The carrying of ammunition is also subject to authorisation (ammunition in the usual calibres will be provided on site).
Rebooking by the customer before the start of the trip:
Depending on the organiser, a rebooking fee may be charged for changes of dates before the travel documents are issued by us. Flight tickets are mostly issued online at the time of booking and are considered personal documents. Rebooking before the start of the journey is considered a cancellation, as the documents have to be reissued. This is associated with costs (new tickets).
Rebooking after confirmation of travel
Any rebookings made by the airline and the tour operator are listed on the final invoice. If, at the customer's request, we process rebookings after departure, additional costs may be incurred.
Cancellation policy
If a trip is cancelled by a participant for personal reasons, there is no entitlement to a refund. In the event of cancellation before departure, cancellation costs may be incurred by us as well as by airlines and other transport companies and the hunting organiser. The costs and fees incurred in such cases will be charged to the client directly or through us. Cancellation costs must be paid within 8 days of the invoice date. For our part, the cancellation costs amount to CHF 100.00/person, plus any telephone/fax charges.
Delivery of travel documents
The flight or train tickets and other travel documents such as permits etc. will be sent to the participants at least 3 weeks before the start of the trip and after receipt of payment.
Unused tickets
The charter airlines do not grant refunds on unused flight segments or on completely unused tickets. In the case of rail travel, refunds may be granted, but this must be checked on a case-by-case basis.
Loss of travel documents
We recommend that you make the exact ticket numbers and a photocopy of the travel documents and keep each separately. We cannot accept any liability in the event of loss of travel documents by the participant.
Insurance
Insurance is the responsibility of the traveller. Please check before departure whether you have sufficient insurance cover for e.g. travel cancellation, health, accident and liability costs.
Passport / Visa / European Firearms Passport
You are responsible for complying with individual passport, visa, customs and foreign exchange regulations and for obtaining the necessary documents. Swiss citizens travel with a valid passport or ID. If you are a hunter or sport shooter and wish to take your personal weapon(s) with you on a hunt, it is compulsory for each participant to have a European Firearms Pass in which the weapon(s) is/are registered.
Warranty
We adhere to an objective description of the services and check our partners. If the customer nevertheless has cause for complaint because the service does not correspond to our description or is afflicted with considerable defects, the following procedure is to be followed: The customer immediately informs the service provider (e.g. gamekeeper of the lodge) or our representative on site and/or us and demands immediate remedy. If no remedy can be provided, a written confirmation of the reported deficiencies is to be requested, which the relevant agencies are obliged to do. Should a significant change in the programme be made during the trip, we will reimburse a maximum of any difference between the agreed price and the service actually provided.
Liability
Our liability is based on Art. 14 and 15 PauRG. We are not liable for indirect damage (loss of wages or similar).
If MFCS is liable for damage caused by contracted companies (hunting organisers, airlines), the client must assign his claims for compensation to us. We accept no liability in the event of: loss of personal effects and/or valuables (camera, jewellery, cash, credit cards, weapons, etc.); programme changes due to flight or flight route changes, delays, etc.; for local events not booked by us. For events which occur as a result of force majeure and which neither we nor the service providers arranged by us could have foreseen despite all due care (strike, riots, earthquakes, etc.); omissions caused by the customer before or during the trip (e.g. in connection with compliance with official regulations). Liability is limited to a maximum of the reimbursement of the arrangement price already paid before the start of the trip, and thereafter to twice the price of the service affected by the defect or damage. This limitation does not apply to personal injury and also not in the case of intent or gross negligence. Pursuant to Art. 12 para. 1 PauRG, complaints must be made in writing and must be accompanied by the likewise written confirmation obtained by the customer on site in the event of a defect. The complaint must then be received by us no later than 4 weeks after the end of the trip, otherwise any claim is forfeited. All claims for compensation are subject to a limitation period of one year after the end of the journey.
Ombudsman
Prior to any legal action, we recommend that clients contact the independent Travel Ombudsman. The ombudsman aims to reach a balanced and fair settlement between us and the customer in any kind of problem. The address of the ombudsman is: Ombudsman of the Swiss Travel Industry, P.O. Applicable law and place of jurisdiction
The contractual relationship between the client and MFCS is governed exclusively by Swiss law. The place of jurisdiction is Uttwil.
